Danger, Inc. was a company specializing in hardware design, software, and services for mobile computing devices. Its most notable product was the T-Mobile Sidekick (also known as Danger Hiptop), which was the first smartphone to capture the attention of pop culture celebrities and teenagers. The Sidekick (hiptop) was a pioneer in client-server ("cloud"-based) smartphones and created the App (Applications) marketplace, later popularized by Android and iOS. Danger was acquired by Microsoft on 11 February 2008, for a price rumored to be around $500 million (USD).[2]

The company was originally started by former Apple Inc., WebTV and Philips employees Andy Rubin, Joe Britt, and Matt Hershenson. Co-founder Andy Rubin left in 2003 to create the company Android, which was later acquired by Google.
After the Microsoft acquisition, the former Danger staff were absorbed into the Mobile Communications Business (MCB) of the Microsoft Entertainment and Devices Division, where they worked on a future mobile phone platform known as "Project Pink" which would eventually be released as Kin.[3] Because of poor sales, production was ceased just a few weeks after its release. The Kin development team was folded into the Windows Phone team, and Microsoft stopped promoting the devices.[4]
By October 2009, most of the ex-Danger employees had left Microsoft.[5] Until March 2013, Rubin headed Android development, and brought former Danger Director of Design Matias Duarte to Google.

The Register described the Microsoft acquisition as "a classic case of M & A failure, where the acquirer has failed to integrate either the technology or the people from the company that it bought."[6]

In an October 10 letter to subscribers, Microsoft expressed its doubt that any data would be recovered.[7]
The customer's data that was lost was, at the time, being hosted in Microsoft's data centers.[8] Some media reports have suggested that Microsoft hired Hitachi to perform an upgrade to its storage area network (SAN), when something went wrong, resulting in data destruction.[9] Microsoft did not have an active backup of the data and it had to be restored from a month-old copy of the server data, totalling 800GB in size, from offsite backup tapes. The entire restoration of data took over 2 months for customer data and full functionality to be restored.[10]
The Danger/Sidekick episode is one in a series of cloud computing mishaps that have raised questions about the reliability of such offerings.[11]

California considers adding meat to cancer-alert list
California is examining new World Health Organization findings to determine whether to add red meat and foods like hot dogs, sausages and bacon to a cancer-alert list, setting the stage for a potential battle with the meat industry over warning labels.
The inclusion of meat and processed meat on the list could reduce consumer demand, hurting major producers and processors like Hormel Foods Corp and JBS USA. It could also open the door wider for litigation against meat companies from consumers diagnosed with certain types of cancer.

California has often been at the forefront of consumer-oriented initiatives, particularly regarding agriculture. It rolled out laws for larger chicken cages and restrictions on antibiotic use for livestock ahead of much of the rest of the country.
Now the meat industry is focused on what the state will do after a unit of the WHO on Monday said processed meat can cause colorectal cancer in humans. It said the risk of developing cancer is small, but increases with the amount of meat consumed. The meat industry maintains that its products are safe to eat as part of a balanced diet.
California's Proposition 65, an initiative approved in 1986, requires that the state keep a list of all chemicals and substances known to increase cancer risks. Producers of such products are required to provide "clear and reasonable" warnings for consumers.
Some Proposition 65 experts expect California to add processed meats to the list. Typically, once an item is added, it is up to the maker to prove to the state that its product is not dangerous enough to warrant a warning label, experts say.
Starbucks Corp is embroiled in a lawsuit filed by a non-profit group in California over whether its coffee contains enough of the carcinogen acrylamide to pose a cancer risk, and should be labeled accordingly under Proposition 65.
The meat industry is adamant it will escape having to put warning labels on packages of bacon or hot dogs. It says a 2009 California appellate court ruling confirmed federal authority over labels for meat from plants inspected by the U.S. Department of Agriculture.

The institute represents companies including Cargill Inc , Tyson Foods Inc and Kraft Heinz Co.
"The state can't force a label on federally inspected product," said Janet Riley, president of the National Hot Dog & Sausage Council and a NAMI senior vice president.
But a legal fight could follow. Private lawyers, or even the state of California, could file lawsuits in an attempt to overturn the 2009 ruling and force meat companies to apply labels, Coughlin said.
If that happens, NAMI "would wave the court of appeals decision. It'd be a stupid suit to even try to initiate because it's already been decided," he said.
Red meat is less likely to be added to California's list because it was classified as "probably carcinogenic," Coughlin said. That put it in the WHO unit's "group 2A" category, joining glyphosate, the active ingredient in many weedkillers, made by Monsanto Co.
Since the WHO's classification of glyphosate in March, Monsanto has faced a slew of lawsuits from personal injury law firms around the United States that claim the company's Roundup herbicide has caused cancer in farm workers and others exposed to the chemical.
In September, the California environmental office gave notice that it intended to list glyphosate under Proposition 65.
Monsanto has asked state officials to withdraw the plan, arguing that California's actions could be considered illegal because they are not considering valid scientific evidence.

Wild waves pose danger in Southern California
SEAL BEACH, Calif. - Two big storms are churning off both U.S. coasts - Hurricane Cristobal in the East, and Marie in the West, downgraded Wednesday from a hurricane to a tropical storm.
Both are hundreds of miles off shore, but they are generating life-threatening rip currents and dangerous waves on both coasts.

In Southern California, high surf warnings are up from Baja to Santa Barbara.
The waves have killed at least one person - a surfer near Malibu who was pulled unconscious from the water.
The waves here reached as high as two-story buildings Wednesday. It's a surfer's delight - but the swells also required the rescue of dozens of people along Southern California's coast.
Nearly 200 were pulled from the water Tuesday in Los Angeles and Orange County.
"This is the biggest swell I've seen in 25 years," said Joe Bailey, the lifeguard chief at Seal Beach in Orange County.

"It makes it difficult even bring a victim back in through the surf. It's so large that we are having to take victims to certain parts of the beach where the surf is way less," he said.

Real estate fund investors build house of rising returns
You've been mocked. You've been humiliated. You've been insulted.
If it's any comfort, lots of other people are trying to sell their homes, too.
But real estate mutual funds are faring surprisingly well in the worst real estate market in decades. One reason: Real estate funds invest in commercial properties, which march to a different drummer than the residential market. Will the commercial real estate rally continue? Probably but it wouldn't hurt to move in slowly.
Real estate funds invest primarily in real estate investment trusts, or REITs which, in turn, invest in apartments, offices, storage facilities and other commercial real estate. Real estate funds have gained an average 6% this year, vs. a 5.3% loss for the Standard & Poor's 500-stock index with dividends reinvested.
REITs have high dividend yields, which make them popular in uncertain markets like, say, this one. The average REIT yields 5.17%, according to the National Association of Real Estate Investment Trusts, a trade organization. In contrast, 10-year Treasury notes yield 4.04%, and the S&P 500 yields just 2.01%.
Dividends help cushion your portfolio in market downturns. And REITs, by nature, are dividend machines. REITs must pay out at least 90% of their taxable income to investors through dividends.
Inflation fears help REITs, too. The consumer price index, the government's main gauge of inflation, has gained 3.9% for the 12 months through April. Food and energy prices have soared far more, raising fears of a burst of persistent inflation.
People tend to buy real estate, gold and other tangible assets when the value of paper money declines. "In the long term, physical property has offered a hedge against inflation," says Joe Rodriguez, lead manager of the AIM Global Real Estate fund.
Finally, REITs are also doing well because Wall Street hit them with a wrecking ball last year. The average REIT fund fell 14.7% in 2007, according to Morningstar, the mutual fund tracker. "The REITs' elastic band got stretched so far in one direction last year that there was nowhere to go but up," says Alec Young, strategist for S&P.
Apartment REITs have fared best this year. As banks have tightened their lending standards, more people have had to rent instead of buying their own home and that helps apartment REITs. Continually falling home prices also spur rentals: People figure they can buy later at a lower price. And, with foreclosures going up, former homeowners have to rent. "They have to live somewhere," Rodriguez says.
Associated Estates Realty Corp. (ticker: AEC), is one of the top-performing REITs this year. The apartment REIT has soared 46% this year, including reinvested dividends. AEC's net rent rose 3.1% in the 12 months ended March, and 4.1% for its Midwest holdings.
The biggest problem with REITs is that they're economically sensitive that is, they fare best when the economy is roaring, office buildings are filled, and shopping centers hum. Unfortunately, the economy is barely meowing at the moment, which is why Rodriguez likes health care REITs. "Whether the economy is anemic or boring, you still have to go to the doctor or the dentist," he says.
S&P REIT analyst Robert McMillan likes high-end shopping-mall REITs, which sound like an economically sensitive sector if there ever was one. He argues that retailers sign long-term leases and tend not to shutter stores lightly. His favorite: Simon Property Group (SPG), a widely diversified retail REIT.
For most people, a real estate mutual fund is the best way to invest in real estate securities. But there's a surprising amount of variety in real estate funds. For example, CGM Realty fund, run by star manager G. Kenneth Heebner, has rocketed to a 325% gain the past five years. In large part, that's because Heebner defines real estate very broadly, including companies with very large land holdings.

Currently, the fund has a big interest in raw materials. CGM Realty's largest holding in December, the latest data available, was the Mosaic Company, which makes fertilizer. Morningstar classifies Pimco Real Estate Real Return as a real estate fund, although it invests in complex derivatives that match the Dow Jones Wilshire REIT Index. The rest of the fund's assets go to inflation-indexed bonds and other bonds.
If you're thinking about wading into REITs or real estate funds, take your time. If the economy slows dramatically, REITs will hit your portfolio like a ton of bricks. But if you start adding to real estate securities now and reinvest the dividends you could have concrete returns when the economy recovers.

"Prosecutors performance reviews should focus less on winning trials, and reflect greater emphasis on legal knowledge, analysis of issues, and finding justice," the committee recommends. "This recommendation is not meant to suggest that the IPPEC has reached any conclusion regarding any allegations of criminal wrongdoing," the report says."It is worth noting that almost every member of the OCDAs Office who was interviewed said that he or she would welcome an investigation and was confident the investigation would find, with perhaps one or two outliers, no intentional misconduct by a member of the OCDAs Office."
At a minimum, the commission says, the DA's office should request a grand jury investigation to demonstrate transparency and to "foster confidence" in the Orange County justice system.
The committee evaluated Rackauckas's office for six months, examining thousands of pages of public documents and interviewing dozens of prosecutors, criminal defense attorneys, judges, and law enforcement officers.
The probe was launched after county prosecutors and sherif's deputies were accused of abusing a complex network of jailhouse informants and selectively presenting evidence gleaned from it.
It's common for law enforcement authorities to enlist informants to help bolster a case. The tactic is perfectly legal, even when the informant receives something for cooperating. But in some Orange County cases, jailhouse informants, at the direction of sheriff's deputies, allegedly had conversations with inmates who were represented by lawyers, violating the inmates right to counsel.
County prosecutors and sheriffs also have been accused withholding some evidence gathered by informants from defense attorneys -- a violation of a defendant's right to due process. One prosecutor who was found to have given less than credibletestimony under oath has resigned.
The revelations have jeopardized numerous murder prosecutions, with some accused killers walking free. Some sheriff's deputies haverefused to testify in criminal cases.
The seriousness of the scandal was illustrated last year, when Superior Court Judge Thomas Goethals ejected the entire DA's office -- all 250 prosecutors -- from a penalty hearing for mass murderer Scott Dekraai, who pleaded guilty in 2014 to fatally shooting his ex-wife and seven others in a hair salon in 2011.Goethals said prosecutors Gary Sherwin had committed "significant" violations of due process and called some of their actions a "comedy of errors."

The county sheriff's department has acknowledged deficiencies in jailhouse informant program and has begun reform efforts. Rackauckas has said his office would welcome a thorough investigation.

The new synthetic diamonds have created ripples throughout the jewelry industry.

To see how good these new "cultured" diamonds are, Good Morning America visited the International Gemological Institute to conduct a test, using three diamonds labeled A, B and C. Two were natural, and the third labeled C was made by Apollo.

First, the lab technicians used a diamond tester, a typical tool that a retail jeweler would have on hand. The diamond tester beeped for each gem, indicating that they were all diamonds.
"If these are synthetic, they're excellent," said David Weinstein, executive director of International Gemological Institute.
A Red Flag
During the next set of tests, however, the lab-made diamond was spotted through the use of sophisticated equipment found only in diamond-grading labs. Special devices to detect synthetics can shine a light through a stone to analyze its refractory qualities or use ultraviolet light to reveal the crystal's internal structure.
The synthetic diamond raised a flag right away when a close inspection with a De Beers DiamondView revealed a red-colored "fluorescence" undetectable to the eye or a jeweler's loupe that is characteristic of a synthetic diamond exposed to high-energy ultraviolet radiation.
Both companies promise their diamonds will be properly labeled, but they do recognize the potential for fraud.
"I think their concern basically is they don't want this type of product to be represented as a natural stone, and that's a legitimate concern," said Carter Clarke, founder of Gemesis. "And we have that same concern."
